Form for IPPC communication in accordance with the
Decree of the Ministry of Environment and Land Protection of 29 May
2003
Article 16, point 3, of
Directive no. 96/61/EC provides that:
"reports on the application of this Directive and on its
efficacy with respect to other environmental protection Community
tools are prepared according to Articles 5 and 6 of Directive no.
91/692/EEC. The first report will regard the first three years from
the date in which Article 21 of this Directive was applied. The
Commission presents this report to the Council accompanied, if
required, by proposals."
The European Commission’s Decision of 31 May, 1999
concerning the questionnaire on Directive no. 96/61/EC for
integrated pollution prevention and control (IPPC) provides to:
"Supply available representative data on limit values for each
category of activities as per Attachment I and, if required, the
Best Available Techniques from which these values are taken.
Describe how such data have been chosen and collected. Before or
during the reporting period, the Commission can suggest guides to
reply to this question, for some sectors, particularly on the basis
of information published in accordance with Article 16, point 2. In
the absence of such a guide data can, for example, be expressed as
a limit value field."
In 2001, member States sent the Commission a first report with
available representative data on emission limit values for specific
categories of Attachment I to Directive no. 96/61/EC. On 31
January, 2003 the IPPC Experts Group (IEG) discussed the updating
of the report on emission limit values and consequently approved a
new document containing guidelines for communications from Member
States.
Legislative
Decree no. 372/99 (Article. 11 – Exchange of information)
provides that:
"Every three years, by 30 April, Relevant authorities transmit
to the Ministry of Environment and Land Protection a communication
on the application of this Decree and particularly on emission
limit values applied to plants as per Attachment I. Authorities
should also transmit the Best Available Techniques on which these
values are based, according to a specific form (established by the
same Decree) in conformity with European Commission regulations.
The first communication must be sent within thirteen months from
the date in which this Decree enters into force. Every three years
and for the first time within eighteen months from the date in
which this Decree enters into force, the Ministry of Environment
and Land Protection provides to send the information to the
European Commission, as per paragraph 1."
On 1 October, 2003 the Official Gazzette no. 228 published the
Decree of the Ministry of Environment and Land Protection of 29 May
2003 on "Approval of the form for communicating the application of
Legislative Decree no. 372/1999, containing the implementation of
Directive no. 96/61/EC on integrated pollution prevention and
